Who Pays the Work Injury Claim

The employer is ultimately responsible for your work injury claim, but most employers have workers compensation or liability insurance and these companies will ultimately share the burden with the employer. One of the biggest problems that employees have when make in work injury claims is that they fear repercussions from their boss or employer.

This is always been a big problem in the area of work related injuries. Some employees really like their employers and no matter how bad the injury or pain that they feel on a regular basis, they would never even think of suing these wonderful people. These people have provided them with jobs and job related perks for quite some time now. The last thing that you're going to want to do, to these people whom you have grown to trust and develop friendships with, is penalized them for your problems.

Here's how it works, you file a claim against your employer, they contact their insurance company and the insurance company will usually handle it from there. If you're employer is only insured for $1 million and you're suing them for $3 million, the insurance company will only pay $1 million and the employer will have to come up with the other $2 million, if you win in court.

It's a little more complicated than this, but rest assured, the money that you are seeking is going to cost your employer a small fortune as his insurance costs rise in the future.
